RENTAL AGREEMENT

This vacation rental contract is a legal agreement between Eden Island Villa (also referred to as the “Homeowners” "Owner" and “Landlord” and “Property Manger”) and you, the Renters (also referred to as “Tenants” and “Guests”). This contract is entered into agreement as of the date when the Renters place their reservation online and the reservation is screened and accepted by the Homeowner. The Homeowner will notify the Renters by email or written mail when their reservation is accepted.

1. CHECK-IN TIME IS AFTER 3 P.M.
CHECK-OUT IS 10 A.M.

A late check-out is subject to extra rental charges.
There are no refunds for early departure.

2. All properties require a 3 night minimum stay. Longer minimum stays, usually 7 nights, are generally required during holiday periods or for special events: Halloween, Xmas, Carnival, and Easter. If a rental is taken for less than 3 nights, the guest will be charged the 3-night rate.

3. NO DAILY MAID SERVICE - Rates include a one-time linen-towel setup and cleaning the day the tenant leaves. While linens and bath towels are included in the house, daily maid service is not included in the rental rate, however, additional cleanings are available at an additional rate.

4. This is a NON SMOKING unit. A 500€ penalty fee will be charged to your credit card if we find evidence of smoking inside the property.

5. PETS are not permitted in rental units. If you bring pets, you may be grounds for immediate termination of this agreement and Tenants shall be evicted and then immediately vacate the premises. without any refund. Remember also that in the Seychelles a quarantine is required from the government.

6. The Renter must be 25 years of age to book this rental property.

7. Tenant will leave the premises in good and habitable condition. Leave it as you found it. Guests will be responsible for paying any damages caused directly or indirectly by themselves or their guests during their stay. We will charge your credit card for any damaged or missing items. Landlord or his/her agent will submit to Tenant an itemized list of any lawful deductions and any damages that have been caused by the Tenant within fourteen (14) days after the termination of the tenancy.

8. Tenant shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature may be grounds for immediate termination of this agreement and Tenants shall be evicted and then immediately vacate the premises, without any refund. Quiet hour starts at 10 PM. Tenants will not park EPV in front of other homes.

9. House Activities – No candles are to be used at any time. No parties/showers/gatherings are allowed without consent from the owner. For use of the Club House for parties, a written VMA (Eden Island Village Management Association) permission is required with a copy to the Owner/Manager and costs will be charged to the Tenant.

10. Tenant agrees to use and occupy the leased property at Tenant’s own risk and hereby indemnifies Owner/Operator from all claims from any injury or death of any person or for the loss of or damages to any property of Tenant or Tenant’s agent, guests, or other third parties.

11. Owner reserves the right to refuse service to anyone. Owner will not be responsible for accidents or injury to guests or for loss of their money, jewelry or valuables of any kind.

12. CAUTION – One day rental cost in cash is required at check-in with balance fully paid. Caution will be returned at check-out if no damage occurred.

13. MAXIMUM OCCUPANCY - The maximum number of guests is the one agree at booking, which are always limited to the numbers of beds available in the property.

14. Owner reserves the right to terminate a reservation at any point. Tenant will not create a nuisance or excessive noise that interferes with the peace and quiet of the neighborhood.

15. Tenant understands that owner has made every effort to accurately describe the premises via pictures and descriptions. If the property does not meet Tenant's expectations, but does meet the basic standards of habitability under the VMA (Village Management Association) of Eden Island and the Seychelles law, Tenant will not be entitled to a refund of rent money and will have no claim or recourse against the owner.

16. FALSIFIED RESERVATIONS - Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

17. WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance.

18. HOLD HARMLESS - The Tenants and Tenants' Guests shall hereby indemnify and hold harmless the Landlord/owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the Landlord/owner may maintain on the property does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.

19. This property is privately owned; the owners of the property (“Owners”) are not responsible for any accidents, injuries or illness that occurs while on the rental premises or its facilities. The Owners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, you agree to release Owners (and all of their partners, employees, officers, agents, representatives), and agree to indemnify them against, and hold them harmless from and against, any and all injuries, liability, claims, demands, causes of action, costs (including attorneys' fees), to or by you, or to any other person you bring onto the rental premises or to any third person, that arise from, with respect to, are in any way related to or in connection with, directly or indirectly, your presence, rental, occupation or use of the property premises; whether or not caused, in whole or in part, due to the sole, joint or concurrent negligence or gross negligence of the owners.

20. To book the property 50% deposit is required which can be paid by PayPal, VISA or MasterCard. Bank transfer deposit payment should be done within 5 working days. Balance is due in cash at arrival, unless other agreement is taken in written as 10 days prior arrival to be paid by PayPal or Credit Card.



RESERVATION CANCELLATIONS

A 200€ cancellation fee will be charged for canceled reservations. Advance payments less the cancellation fee are refunded according to the following schedule:

Cancellation Notice on Rentals:
60 days prior to the date of arrival: 50% of the deposit (equal of 25% of full amount)
30 days prior to the date of arrival: 20% of the deposit (equal of 10% of full amount)
Less than 30 days prior to the date of arrival: 0%
