TERMS OF TRADING

 TERMS OF TRADING

The following information describes how our relationship works. When you respond to enquiries, and submit quotes via the SafariNow system, you are deemed to agree to these terms.

Commission

·         You agree to pay commission on any bookings made by customers who are introduced to you via SafariNow.

·         The minimum commission charge is 15% + VAT (i.e. 17.1%).

o        Commission is deducted from the total quote value.

o        Commission includes payment processing and on-payment charges.

o        A minimum commission of R45.00 applies if the booking total is under R305.00.

·         You agree not to attempt to take conversations with customers ‘offline", in order to avoid SafariNow commission.  Bookings which are taken ‘offline’ are still commissionable.

Cancellations

·         In the event of a cancelled booking, your own cancellation policy will apply. If you don’t have your own policy, then the following default policy will be applicable:

·         Where cancellation occurs:

o        On arrival or during the stay - the full payment due may be retained.

o        0 - 14 days before arrival, no show - full deposit paid may be retained.

o        15 - 28 days before arrival - 75% of deposit , or 25% of full quote value may be retained (whichever greater)

o        28 + days before arrival - 50% of deposit, or 25% of full quote value (may be retained (whichever greater).

Refunds

·         On receipt of a request from a customer to cancel the reservation, SafariNow will:

o        Notify you, and refund the relevant amount (if any) to the customer within 3 working days. SafariNow will be entitled to claim this amount back from you.  

o        The amount should be paid back to SafariNow within 3 working days, and if it is not repaid, SafariNow is entitled to deduct the outstanding amount from a future booking.

·         SafariNow will levy a handling charge of 15% (+ VAT) on the amount forfeited by the customer, with a minimum charge of 5% (+ VAT) on the booking total.

·         In the event of customers cancelling because of sickness or death in their immediate family, SafariNow encourages a policy of full refund; we fully refund our commission for these ‘compassionate" refunds.

On-Payments

·         SafariNow aims to on pay all monies owed to you within 4 working days of receipt thereof. You agree to honour bookings processed by Safarinow.com prior to receipt of these funds.

·         We are reliant on our online banking service to pay you monies owed. Sometimes during high-usage periods this platform becomes temporarily inaccessible. You agree that in this situation on-payments may be delayed.

Correctness of information and Reviews

·         You hereby undertake to ensure that all of the information that you supply to us is correct and continuously updated, including the description of your rates and the services offered.

·         SafariNow invites all guests who stay at your establishment to submit a review of their stay which we publish on your homepage. You hereby agree to allow SafariNow to publish these reviews.

Bank Details - Your Responsibility

·         It is the responsibility of establishment owners to ensure that SafariNow has correct bank details on record.

·         Should a change in ownership or bank account take place, SafariNow must immediately be notified so that old account details can be removed.

·         SafariNow will not be held responsible for payments made into incorrect accounts if not notified timeously of the change.

·         Once the bank details have been uploaded you are sent an acknowledgement of changes made and should re-verify the account details

Chargebacks – Your Responsibility

·         Online payments processed by SafariNow can in certain circumstances (typically fraud) be contested by the cardholder, and the transaction reversed. This is known as a "charge back".

·         In this case, SafariNow is obliged to pay the credit card transaction amount back to our merchant bank. You agree that you will refund to SafariNow any amounts on-paid to you, which are subsequently charged back.

Double Bookings

·         Double bookings are the result of quoting for a customer’s enquiry, or accepting a customers booking and then selling the same accommodation to another customer. Your quote is legally binding (for as long as you make it valid), and you must honour the quote, or booking.  

·         You are responsible for resolving the double booking.

·         In the case that you fail to resolve the double booking, we will also try and source alternative accommodation and may have to pay the difference between your quote and the amount of the alternative accommodation.  In this case SafariNow will be entitled to recover this amount from you.

·         SafariNow is entitled to charge the full commission on the quote value of the double booking.

·         Your ranking on SafariNow will be negatively effected and you will move down on our search results

De-listing

·         SafariNow reserves the right to de-list your establishment where there is non-compliance with these terms and conditions or for any reason which may result in poor customer experience. These reasons include but are not limited to: Repeated double-bookings, failure to update your establishment information on request, repeated failure to respond to enquiries timeously, or misrepresentation of the standard / nature of your establishment and services offered.

Service Interruptions

·         SafariNow uses best efforts to maintain the SafariNow reservation service and the technology supporting it, but are not responsible for the results of any lost profits or other consequential damages that may result from any such defects that may be found to exist, or which may occur from time to time, in the SafariNow service.
